Terms and Conditions of Accommodation for HOP INN Japan

Article 1 Scope of Application  

  1. The accommodation contract and related agreements entered into between Hop Inn Hotel (“the Hotel”) and the guest shall be governed by the provisions of these Terms and Conditions. Any matters not stipulated herein shall be governed by applicable laws and regulations or generally established practices.

  2. Notwithstanding the preceding paragraph, when the Hotel agrees to a special provision that does not conflict with laws or established practices, such special provision shall take precedence.

 

Article 2 Application for Accommodation Contract

  1. A person who wishes to apply for a contract of accommodation at this hotel shall provide the following information to this hotel

    • Name and contact details of the guest

    • Date(s) of stay and estimated time of arrival

    • Accommodation plan selected by the guest

    • Room charge (in principle, based on the basic accommodation charge listed in Appendix 1)

    • Other information deemed necessary by the Hotel

  2. If the guest requests to extend the stay beyond the dates specified in item (2) above, such a request shall be treated as a new application for an accommodation contract at the time the request is made.

  3. The guest acknowledges that, except where expressly approved by the Hotel, the guest may not transfer, assign, or resell the rights or status of an accommodation reservation or contract to a third party, in order to prevent inappropriate resale and to ensure fair accommodation opportunities for all guests.

  4. The accommodation plan specified in paragraph 1 (3) shall be valid only at the time of application. If the guest wishes to change to another plan, a new application must be submitted. The previous reservation shall not be automatically cancelled and must be handled through the appropriate cancellation procedure.

  5. The use of services provided through the official website of the Hotel (www.hopinnhotel.com) shall be governed by these Terms, as well as by the Website Terms of Use, HOP REWARD Membership Terms, Booking Terms, and other terms and agreements stipulated by HOP INN HOTELS ( Hop Inn Hotel Public Company Limited and Erawan Philippines, Inc. and affiliates) and their affiliates. Please read all the terms carefully before you use them.

  6. Personal information obtained by the Hotel shall be handled in accordance with the Privacy Policy 

 

Article 3 Conclusion of the Accommodation Contract

  1. The accommodation contract shall be deemed concluded when the Hotel accepts the guest’s application, unless the Hotel proves that it did not accept the application.

  2. Upon conclusion of the accommodation contract, the guest shall pay a deposit, up to the amount of the basic accommodation charge for the entire period of stay, by the date specified by the Hotel.

  3. The deposit shall first be applied to the room charge ultimately payable by the guest, and if the provisions of Articles 6 and 18 apply, the deposit shall be applied in the order of penalty followed by compensation, and any remaining amount shall be returned at the time of payment of the charges according to Article 12. 

  4. If the application fee pursuant to Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same paragraph, the accommodation contract shall be invalid. However, this shall only apply if the Hotel has notified the guest of this when specifying the due date for payment of the application fee.

 

Article 4 Special Contract that Does Not Require Payment of Application Fee

  1. Notwithstanding paragraph 2 of the preceding Article, the Hotel may agree to a special provision that exempts the guest from paying a deposit after the contract has been concluded.

  2. If the Hotel does not request payment of a deposit or does not specify a due date when accepting an application, it shall be deemed that the Hotel has agreed to such special provision.

 

Article 5 Refusal to Conclude an Accommodation Contract

  1. The Hotel may refuse to conclude an accommodation contract in any of the following cases:

    1. When the application for accommodation is not in accordance with these General Terms and Conditions.

    2. When there is no room available due to full occupancy.

    3. When the person seeking accommodation is likely to act in violation of laws, public order, or good morals. 

    4. When it is recognized that the person who intends to stay falls under any of the following categories:

      • A)    Organized crime groups (bōryokudan), members, quasi-members, affiliates, or other antisocial forces as defined by the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991).

      • B)    Corporations or organizations controlled by such groups or members.

      • C)    Corporations whose officers include members of such groups.

    5. When the person seeking accommodation has caused a significant disturbance to other guests.

    6. When the person is a patient of a designated infectious disease as defined in Article 4-2, paragraph 1, item 2 of the Hotel Business Act.

    7. When the person makes violent, coercive, or unreasonable demands, including but not limited to:

      • (1)Requests for services not provided by the Hotel;

      • (2)Requests for services contrary to laws or public order;

      • (3)Unjustified demands for discounts or room upgrades;

      • (4)Unjustified demands for complimentary meals or benefits;

      • (5)Unjustified demands for discounts or room upgrades;

    8. When the person is intoxicated or likely to cause significant nuisance to other guests or employees. (Based on prefectural ordinances).

    9. When the person has verbally or physically abused, threatened, or defrauded staff or other guests.

    10. When the person has made false or defamatory statements about the Hotel, its employees, or other guests on social media or public platforms.

    11. When the person has previously caused trouble at any Hop Inn Hotel or related property.

    12. When the Hotel is unable to provide accommodation due to natural disasters, facility failures, or other unavoidable reasons.

    13. Other cases as prescribed by prefectural ordinances.

 

Article 6 Guest's Right to Cancel Contract

  1. The guest may request the hotel to cancel the accommodation contract.

  2. If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest (excluding cases where the deposit payment deadline specified by the hotel under Article 3, Paragraph 2 has not yet passed), the hotel shall charge a cancellation fee in accordance with Appendix 2. However, if the hotel has agreed to a special provision under Article 4, Paragraph 1, the cancellation fee shall be as notified to the guest. 

  3. If the guest fails to arrive by 24:00 on the scheduled check-in date (or within one hour after the designated arrival time if previously specified), the hotel may treat the accommodation contract as canceled by the guest.

  4. If the reason for the guest’s late arrival is due to delays in public transportation, such as trains or flights, or other circumstances not attributable to the guest, no cancellation fee under Paragraph 2 shall apply.

 

Article 7 Right of this hotel to cancel the contract

  1. The hotel may cancel the accommodation contract under the following circumstances:

    1. If the guest is deemed likely to engage in conduct contrary to laws, public order, or good morals in relation to the accommodation, or has already engaged in such conduct.

    2. If the guest falls under any of the following:

      • A)    An organized crime group, a member thereof, a quasi-member, or other antisocial forces.

      • B)    A corporation or organization controlled by an organized crime group or member.

      • C)    A corporation with an officer who is a member of an organized crime group.

    3. If the guest causes significant inconvenience to other guests. 

    4. If the guest is infected with a specified infectious disease as defined under Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act.

    5. If the guest engages in violent or coercive demands related to accommodation, or requests burdens exceeding reasonable limits, including any similar acts in the past:

      • (1) Requests for services not provided by the hotel, or services contrary to laws, public order, or good morals

      • (2) Requests for post-contract discounts without a valid reason

      • (3) Requests for room upgrades, meals, or other services not included in the contract without a valid reason

      • (4) Other requests exceeding reasonable limits

      • (5) Any acts similar to those listed in (1) through (4)

    6. If the guest is intoxicated or behaves in a manner that significantly inconveniences other guests or hotel staff. (Based on prefectural ordinances).

    7. If the guest verbally or physically assaults, threatens, extorts, or commits fraud against hotel staff or other guests.

    8. If the guest posts false, defamatory, or malicious content about the hotel or its guests/staff on social media or forums.

    9. If the hotel cannot accommodate the guest due to natural disasters or force majeure.

    10. Other cases as provided by prefectural ordinances.

    11. If the guest violates hotel rules such as smoking in rooms, tampering with fire prevention equipment, or other prohibited acts necessary for fire prevention.

  2. The provisions of the preceding paragraph shall not prevent the hotel from claiming damages or cancellation fees from the guest.

 

Article 8 Accommodation Registration

  1. Guests shall register the following items at the front desk of the hotel on the day of their stay:

    • (1) Guest’s name, age, gender, address, telephone number (or mobile number), and email address

    • (2) For foreigners: nationality, passport number, place and date of entry into Japan

    • (3) For foreigners without an address in Japan: a copy of their passport in addition to the items listed in the preceding item

    • (4) Date and scheduled time of departure

    • (5) Names of accompanying persons

    • (6) Other matters deemed necessary by the hotel

  2. If the guest intends to pay the charges following Article 12 by a hotel voucher, credit card, or any other method that can be substituted for currency, the guest shall present them in advance at the time of registration as described in the preceding paragraph

 

Article 9 Hours of Use of Guest Rooms 

  1. The hours during which a guest may use a guest room of this hotel shall be up to the hours determined by this hotel unless otherwise specified in the accommodation plan. However, in the case of a consecutive stay, the guest may use the room for the entire day, except for the day of arrival and the day of departure.
  2. Notwithstanding the provisions of the preceding paragraph, this hotel may accept the use of a room outside the hours specified in the preceding paragraph. In such a case, an additional charge as determined by the hotel will be assessed. However, our hotel may refuse the request when no room is available.
    • Extra charge (varies by hotel) per hour for each room until 1 p.m.

    • 100% of the room charge beyond 1 p.m.

 

Article 10 Compliance with Rules of Use

  1. Guests shall comply with the 'Terms and Conditions of Use' as set forth in the 'Terms and Conditions of Accommodation' while on the premises of the hotel.

 

Article 11 Business Hours

  1. Detailed hours of operation for other facilities will be provided in the pamphlet provided, notices posted in various locations, and in-room information in the guestrooms. 

    • (1) Curfew: No curfew (The entrance is locked from 12:00 midnight to 6:00 the next morning. When leaving, please enter by holding your card key against the black panel at the entrance or use the intercom provided to let us know you are leaving.) 

    • (2) Front desk service: 24 hours 

    • (3) Vending machines, washing machines, dryers, ice machines: 24 hours 

  2. The hours in the preceding paragraph may be changed temporarily if necessary or unavoidable. In such cases, notification will be made by appropriate means.

 

Article 12 Payment of Charges

  1. The accommodation charges, etc., to be paid by the guest shall follow the items listed in the Appendix 

  2. Payment of the accommodation charges, etc., outlined in the preceding paragraph shall be made at the front desk at the time of the guest's check-in or when requested by this hotel, in currency or by a method acceptable to this hotel that can be substituted for currency, such as accommodation vouchers, credit cards, etc. 

  3. Room charges shall not be refunded even if the guest chooses not to stay in the room that this hotel has provided the room to the guest and made available for his/her use. 

 

Article 13 Liability of this hotel

  1. The hotel shall compensate guests for damages caused in the performance or non-performance of the accommodation contract and related agreements, except when the damage is not attributable to the hotel.

  2. The hotel’s liability under the accommodation contract begins either at check-in under Article 8 or upon the guest entering the room, whichever occurs earlier, and ends when the guest leaves the room upon departure.

 

Article 14 Handling When the Hotel Cannot Provide the Contracted Room

  1. If the hotel cannot provide the contracted room, with the guest’s consent, the hotel shall arrange other accommodations under the same conditions whenever possible.

  2. Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange alternative accommodation, it shall pay the guest a compensation fee equivalent to the penalty amount, which shall be applied toward any damages. However, no compensation shall be paid if the hotel is not responsible for the inability to provide the room.

 

Article 15 Handling of Deposited Articles, etc.

  1. In the event of loss, damage, or other loss of or damage to articles, cash, or valuables deposited by a guest at the front desk, this hotel shall compensate for such damage, except in cases where such damage is caused by force majeure. However, if this hotel requests the disclosure of the type and value of cash and valuables, and the guest fails to do so, this hotel shall compensate for the damage up to 50,000 yen.  

  2. The Hotel shall not compensate the guest for any damage when such damage occurs to any of the articles which are brought into the premises of the Hotel by the guest but are not deposited at the front desk unless otherwise determined the damage took place due to the result of willfulness or gross negligence on the part of this Hotel.

  3. Artworks, antiques, and similar items cannot be accepted for deposit.

 

Article 16 Custody of Guest’s Luggage or Personal Effect

  1. If luggage arrives before the guest’s stay and is accepted by the hotel, it will be safely kept and returned at check-in.

  2. After a guest has checked out, if any baggage or personal belongings are left at the hotel, the hotel will, as a general rule, wait for contact from the owner and follow their instructions. However, if no instructions are received from the owner or if the owner cannot be identified, the hotel will keep the items for 90 days from the date of discovery. Items such as food, goods that may compromise hygiene, or other items considered waste (obviously broken items) will be disposed of immediately after checkout, even within the storage period.

  3. The hotel may inspect the contents of any forgotten baggage or personal belongings as necessary to handle them appropriately according to their nature.

  4. If any costs are incurred in returning lost items found at the hotel to their owner, such costs will be borne by the owner.

  5. If any baggage or personal belongings requiring disposal fees, such as large or bulky items, are left within guest rooms, shared areas, or other hotel premises due to the guest’s intentional or negligent act, the hotel may charge the guest for the disposal costs in accordance with applicable laws, plus a handling fee for services provided by the hotel. Furthermore, if it can be objectively presumed that the items were intentionally left behind, or if no contact regarding the items is made within one week after checkout, the items will be considered intentionally abandoned and ownership deemed relinquished.

 

Article 17 Liability of Guests 

  1. If this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.

  1. If the number of nights or rooms booked is reduced, the penalty will be charged according to the above ratio.

  2. Special plans may be subject to separate terms.

  3. Reservations made through channels other than the official Hop Inn Hotel website (www.hopinnhotel.com) may be subject to separate terms.

 

Article 18 Room Capacity

  1. Our hotel does not accept guests exceeding the maximum occupancy of a room. If the number of guests exceeds the designated capacity, you will be required to book an additional room, change the room type, or your stay may be declined. Additional charges may apply.

  2. At our hotel, children under the age of six are considered minors. Children aged six and above will be counted as adults.

Article 19 Modification of the General Terms and Conditions 

  1. This hotel may, at its discretion, change the general terms and conditions in the following cases 

    • (1) When the amendment conforms to the general interests of the guest, (2) When the amendment does not contravene the purpose of the accommodation contract, and the amendment is necessary and appropriate 

    • (2) When the modification of the terms and conditions is not contrary to the purpose of the accommodation contract and is reasonable considering the necessity of the modification, the reasonableness of the content after the modification, the details of the modification, and other circumstances pertaining to the modification.

  2. When the guest makes a reservation for the accommodation contract on or after the effective date of the amended terms and conditions, the guest shall be deemed to have agreed to the amended terms and conditions.

 

Article 20 Language

  1. These terms are prepared in Japanese, with translations in other languages based on them. In case of any inconsistency, the Japanese version shall prevail.
